Departing upstate Rep. John Faso, a Republican, has written a letter to U.S. Transportation Secretary Elaine Chao, urging her to tear down the Scaffold Law, Crain’sreports. Faso’s letter notes that every other state in the country uses a standard of comparative negligence, which can hold workers responsible for job-site accidents. Under the New York law, a co-op or condo board without proper indemnification can be held liable if a worker is injured while drunk or failing to use proper safety equipment.
